The SCA in The "Asia Star" [2010] SGCA 12 held that the respondent's inaction to charter an alternative vessel,�after the appellant failed to deliver a vessel in breach of a charterparty, constituted a failure to act reasonably to mitigate its losses. The SCA found that the�respondent knew of the availability of the alternative vessel but did not charter it allegedly because of the higher freight costs, which the court found not to be excessive, and�also did�not inform the appellant of this possible alternative course of action.

When comparing a possible anti-competitive agreement with the Competition Act, the CCS will examine the competitive environment in the respective markets and the impact the agreement will have. As concluded by the CCS on 18 August 2010, Singapore Medical Association's Guidelines on Fees infringed s 34 of the Competition Act and did not benefit from the Net Economic Benefit exclusion.
